Estate Planning & Probate

  • A basic estate plan consists of a Will, Living Will and Health Care Proxy, and Durable Power of Attorney.  More complex planning may involve a Revocable Living Trust.
  • Thoughtful estate planning can in some cases help to avoid probate (the court process to transfer assets after death).
  • Specialized trusts may include Life Insurance Trusts, Second-to-Die Life Insurance Trusts, and Special Needs Trusts.  
  • We can assist with multi-jurisdictional estate planning in the following states: New York, Arizona, Nevada, Texas, Georgia and Florida.
  • We can also assist with probates and ancillary probates in the same six states. 


  • Chapter 7 Bankruptcy- A Chapter 7 is known as a "liquidation bankruptcy" because it discharges most of your unsecure debt. Statistically, upwards of 95% of all bankruptcies filed are Chapter 7 bankruptcies. To qualify, you must pass a "means test" and have monthly income below the median in your state. You cannot have filed another Chapter 7 bankruptcy and received a discharge in the last 8 years.  
  • Chapter 13 Bankruptcy- A Chapter 13 bankruptcy is known as a "reorganization" and involves a repayment plan that typically lasts 3 or 5 years. Chapter 13 is a good option for debtors who do not qualify for a Chapter 7 because their income exceeds the means test limit; for those who are behind on mortgage payments and wish to keep the house (by getting caught up during the bankruptcy); for those who have nonexempt property that they do not wish to surrender under a Chapter 7.  Chapter 13 is also an option for debtors who filed a Chapter 7 bankruptcy within the last 8 years and do not yet qualify to file another Chapter 7.

Social Security Disability

  • Social Security Disability benefits are awarded to claimants who prove that they can’t work because they have a medical condition that’s expected to last at least one year or result in death.
  • Vigneri has handled many Social Security Disability cases throughout the country and has a proven track record of success. 
  • Your patience and cooperation is required. The more information and medical records you provide, the stronger your case will be.
  • Most cases get denied at the first two levels of review and require a hearing before an Administrative Law Judge. Having a skilled attorney to prepare your case (and you!) for the hearing will significantly increase your chance of success.
  • The application process is lengthy and difficult; and having a competent attorney to assist you can make all the difference in your case!

Jennifer Vigneri is admitted to practice in New York, Arizona, Nevada, Texas, Georgia and Florida. She graduated early from high school and then earned her Associate’s Degree in one year from Monroe Community College. She earned her Bachelor’s Degree from Rochester Institute of Technology and her J.D. from SUNY at Buffalo School of Law. Vigneri then earned a Master of Administration~ Professional Writing Emphasis from Northern Arizona University.

Vigneri also has a background in higher education and is the author of Wills, Trusts, and Estate Administration for Paralegals. Vigneri has taught paralegal classes at the undergraduate level since 2007 and is also an instructor at Monroe Community College.
